Suspects of criminal offences under the media spotlight

The Human Rights Ombudsman Dr Zdenka Čebašek-Travnik points out that excessive media exposure of the suspects, who are deprived of liberty, could interfere with the constitutionally guaranteed human rights to presumption of innocence and personal dignity. This particularly applies to the suspects in the pre-trial criminal procedure, because these are the persons for whom (only) reasons to suspect that they committed or participated in committing a criminal offence exist. If already the circumstances of the case provide legal basis to use police authorization, it does not permit unnecessary and degrading exposure of the suspects to such media attention.  That is why in cases like this the police have to make sure that the individuals concerned are not excessively exposed to the media spotlight.

Media play an important role in ensuring the freedom of expression and the right to be informed, but in such cases the issue of restitution of rights and personal dignity to the persons, who were covered by the media, often remains open. The Human Rights Ombudsman of the Republic of Slovenia pointed to this issue many times before, among other, in annual reports.
