ADMINISTRATION

Staff

As at 31 December 1997 the Office of the Human Rights Ombudsman had a staff of 22 employees, not including the ombudsman and three deputy ombudsmen, of whom 15 had university education, three had college education and four had secondary education. These figures are displayed in Table 3.1.1 below broken down by sex, excluding the ombudsman and the three deputy ombudsmen. Compared with the previous year, there was an increase of four in the number of employees in the office in 1997. Three people were serving traineeships in the office during the year, two with university education and one with college education. After passing their professional exams, two of the trainees were taken on as employees in the office, while the traineeship of the remaining one will be completed in 1998. Also this year we provided for a third-year student at the Social Sciences Faculty in Ljubljana to do her three-week compulsory practice in the office as part of her studies.

Finances

At the proposal of the Human Rights Ombudsman, total funding of 229.7 million tolars (US$ 1.4 million at the Bank of Slovenia exchange rate on 31 December 1997) was allocated in the central government budget for the work of the ombudsman in 1997. Actual spending was lower than envisaged by law, amounting to a total of 227 million tolars (US$ 1.3 million).

Some 132.6 million tolars (US$ 0.76 million) was spent on wages for employees of the office in 1997, while 37.8 million tolars (US$ 0.22 million) was spent on the workings of the institution. These funds were almost entirely used for payment of costs arising directly from the work of the office.

A total of 56.7 million tolars (US$ 0.33 million) was spent on investments, with 28.6 million tolars being used to settle the final part of the contractual obligation for the purchase of office premises, 21 million tolars to pay for office equipment, and 7 million tolars spent on the computerisation of the office and the upgrading of the information system. 

Training

With the aim of achieving the highest possible level of ability and professionalism among the employees in the Office of the Human Rights Ombudsman, great emphasis was again placed on staff training in 1997. Employees attended training courses both in Slovenia and abroad. Three employees attended seminars and other forms of training abroad which related to the ombudsman's area of work. Two of the courses were organised by the Council of Europe: a conference of national human rights institutions in Copenhagen, Denmark, in January 1997 was attended by two employees from the office, and in June one of our employees went on a study visit to the Human Rights Commission and the Court of Human Rights in Strasbourg to learn more about their work. And also in June one of our advisors attended an eight-day interdisciplinary seminar on children's rights organised by the Centre for Children's Rights at the University of Ghent in Belgium.

A two-day working conference and workshop was also organised and carried out last year for all employees of the Office of the Ombudsman. At the conference the principles for improving the relationship between the individual and the state which the ombudsman emphasised in the work report for 1996 were again presented to the employees. It was stressed in particular that every employee of the office must follow these principles in their work. At the workshop, which was conducted in groups, a detailed review of the individual phases in the handling of a complaint was given (acceptance of a complaint, dealing with the complaint, compiling a report), with particular emphasis on establishing the problems arising from a complaint, and a detailed analysis of the way in which a complaint is handled in the proceedings with the ombudsman. A graph showing the procedure for the ombudsman's handling of a complaint is provided as an appendix of this report.

The office's employees also took part in several expert meetings, workshops and seminars. Some of the employees also wrote papers concerning the field of work of the ombudsman which made an active contribution to the implementation of certain forms of education for various participants and the professional public in various fields.

In the autumn 1997 we enabled one of our experts to begin a year’s practical training at the Higher Court in Ljubljana as part of education provided by the employer. Additionally, the office, as the employer, is also covering the costs of postgraduate study for seven employees due to requirements arising from their work, and made it possible for two employees to study for college qualifications.

Premises

Since the start of January 1997 the Human Rights Ombudsman has been operating out of premises at Dunajska cesta 56 in Ljubljana. This has been very important for the work of the ombudsman, and particularly for complainants and employees of the office as the working conditions in the new premises are immeasurably better for both sides, and they make it easier to provide for confidentiality in the procedure as well as appropriate conditions for receiving complainants and discussing their problems with them. So given these circumstances and the way in which the ombudsman works (the ombudsman, his deputies and all employees dealing with a complaint hold discussions with complainants every day), an appropriate number of premises with suitable equipment is provided to receive clients and hold talks with them.

Information system

The computer supported application for office operations introduced in 1996 was supplemented in 1997 with certain new bases (e.g. library, info base). Much emphasis was placed on buying suitable software for the office. All employees use a computer in their work and they are important for acquiring and providing, in the most professional, complete and up-to-date manner, the necessary information to complainants requiring information and advice on complaints they have lodged, and for acquiring the necessary professional information from various databases with which to deal with and resolve complaints. And in addition, the employees can carry out administrative work themselves concerning the handling and resolving of cases.

With the increase in the volume of data and the number of bases, in 1997 we had to replace some of our existing computer equipment with more powerful equipment, while the old machines are being used for other purposes.

Human rights day

As in the two previous years, again in 1997 the ombudsman arranged a reception on Human Rights Day for the highest representatives of the legislative, executive and judicial branches of power, for senior representatives of the church, the universities of Ljubljana and Maribor, of the science sector and representatives of non-governmental organisations dealing with human rights. Also invited were diplomatic representatives of foreign countries accredited in Slovenia. The reception was also attended by the ombudsman of the Republic of Macedonia who, at the time, was heading a working delegation to the Slovenian Human Rights Ombudsman.

Miscellaneous

Last year a summary of the report on the work of the ombudsman was published in English in order to present the work of the Slovenian Human Rights Ombudsman to foreign ombudsmen, related institutions and organisations, and the professional public in other fields who work in the area of human rights protection abroad. A number of internal organisational and other regulations were drawn up and adopted.

ADMINISTRATIVNE INFORMACIJE

Zaposleni

Na dan 31. decembra 1997 je bilo v uradu varuha človekovih pravic brez varuha in treh namestnikov varuha zaposlenih 22 uslužbencev, od tega 15 z visoko izobrazbo, trije z višješolsko in štirje s srednješolsko. V tabeli 3.1.1. so prikazani podatki o zaposlenih v uradu varuha na dan 31. decembra 1997 po stopnji strokovne izobrazbe in spolu - varuh in namestniki varuha niso všteti. V primerjavi z letom prej so bili v letu 1997 v uradu zaposleni štirje delavci več. Med letom so v uradu opravljali pripravništvo trije pripravniki, in sicer dva z visoko in eden z višjo strokovno izobrazbo. Dva pripravnika smo po opravljenem strokovnem izpitu v uradu tudi zaposlili, pripravnici pa bo pripravniška doba potekla v letu 1998. V tem letu smo omogočili študentki tretjega letnika Fakultete za družbene vede v Ljubljani opravljanje tritedenske obvezne prakse med študijem.

Finance

Na predlog varuha človekovih pravic so bila za delo varuha v letu 1997 v državnem proračunu določena sredstva v skupni višini 229,7 milijona tolarjev. Poraba sredstev je bila nižja od zakonsko določenih in je znašala skupno 227 milijonov tolarjev.

Za plače uslužbencev je bilo v letu 1997 porabljenih 132,6 milijona tolarjev (skupaj plače, prispevki in drugi osebni prejemki).

Za delovanje institucije so bila v tem letu porabljena sredstva v višini 37,8 milijona tolarjev. Skoraj v celoti so bila porabljena zgolj za plačilo stroškov, ki izhajajo neposredno iz dela urada.

Za investicije so bila porabljena finančna sredstva v višini 56,7 milijona tolarjev. Za poravnavo zadnjega dela obveznosti po pogodbi o nakupu poslovnih prostorov je bilo porabljenih 28,6 milijona tolarjev, 21 milijonov tolarjev je bilo porabljenih za plačilo pisarniške opreme, sedem milijonov tolarjev pa je bilo namenjenih in porabljenih za informatizacijo urada in dograditev informacijskega sistema.

Izobraževanje

V želji, da bi zagotovili čim višjo stopnjo strokovne usposobljenosti in profesionalnosti zaposlenih v uradu varuha človekovih pravic, je bil tudi v letu 1997 izobraževanju zaposlenih dan velik poudarek. Izobraževanje je potekalo tako doma kot tudi v tujini. Seminarjev in izobraževalnih oblik s področja dela varuha so se v tujini udeležili trije uslužbenci. Dve izobraževalni obliki sta potekali v organizaciji Sveta Evrope - januarja 1997 je bila v Kopenhagnu na Danskem konferenca nacionalnih institucij za človekove pravice, ki sta se je udeležila dva uslužbenca, junija je bil eden od zaposlenih na študijskem obisku pri komisiji in sodišču za človekove pravice v Strasbourgu, da bi se seznanil z delom komisije in sodišča za človekove pravice. Ravno tako se je junija ena svetovalka udeležila osemdnevnega interdisciplinarnega seminarja o otrokovih pravicah, ki je potekal v organizaciji centra za otrokove pravice pri Univerzi v Ghentu v Belgiji.

Tudi v tem letu sta bila za vse uslužbence urada varuha organizirana in izvedena dvodnevni delovni posvet in delavnica. Na posvetu so bila zaposlenim ponovno predstavljena načela za izboljšanje odnosa med posameznikom in državo, ki jih je v poročilu o delu v letu 1996 navedel in poudaril varuh. Posebej je bilo poudarjeno, da mora vsak uslužbenec urada navedena načela upoštevati pri svojem delu. Na delavnici, ki je potekala v skupinah, je bil podrobno podan prikaz poteka obravnave pobude po posameznih fazah (sprejem pobude, obdelava pobude, izdelava poročila), s posebnim poudarkom na ugotovitvi problematike, ki izhaja iz pobude, in podrobnejši analizi načina obravnave pobude v postopku pri varuhu. Grafični prikaz postopka obravnave pobude pri varuhu je podan kot priloga 1 za četrtim poglavjem poročila.

Uslužbenci so se udeležili tudi več strokovnih srečanj, delavnic in seminarjev. Posamezni uslužbenci so s svojimi prispevki s področja dela varuha aktivno sodelovali pri izvedbi izobraževalnih oblik za različne udeležence in različno strokovno javnost.

Jeseni 1997 smo strokovni sodelavki v okviru izobraževanja, ki ga zagotavlja delodajalec, omogočili opravljanje enoletne prakse na Višjem sodišču v Ljubljani. Sedmim zaposlenim delodajalec zaradi potreb, ki izhajajo iz dela, krije stroške podiplomskega študija, dvema uslužbenkama pa je omogočil študij za pridobitev višješolske izobrazbe.

Prostori

Varuh človekovih pravic od začetka januarja 1997 posluje v poslovnih prostorih na Dunajski cesti 56 v Ljubljani. Za delo urada varuha, predvsem pa za pobudnike in uslužbence urada, je bilo to zelo pomembno, saj so v novih poslovnih prostorih tako za pobudnike kot tudi za zaposlene delovne razmere neprimerno boljše, pobudnikom pa je laže zagotoviti zaupnost postopka kot tudi primerne razmere za sprejem in pogovore z njimi. Tako so, upoštevajoč navedeno in način dela varuha (varuh, njegovi namestniki in vsi zaposleni, ki obravnavajo pobude, vsak dan opravljajo pogovore s pobudniki), v ustreznem številu in primerni opremljenosti zagotovljeni prostori za sprejem strank in opravljanje pogovorov z njimi.

Informacijski sistem

Že v letu 1996 uvedena računalniško podprta aplikacija pisarniškega poslovanja je bila v letu 1997 dopolnjena z nekaterimi novimi bazami (knjižnična, info baza... ). Velik poudarek je bil namenjen tudi dokupu ustrezne in manjkajoče informacijske opreme urada. Dejstvo, da vsak zaposleni pri svojem delu uporablja računalnik, je pomembno za pridobivanje in dajanje informacij, pomembnih za čim bolj strokovno, čim popolnejšo in ažurno seznanitev pobudnikov, ki želijo informacijo in nasvete o vloženih pobudah, ter za pridobivanje za obravnavo in reševanje pobud potrebnih strokovnih informacij iz različnih baz podatkov. Ne nazadnje tudi zaposleni lahko sam opravlja administrativno delo v okviru obravnave in reševanja zadev.

Zaradi povečanega obsega podatkov in baz je bilo treba v letu 1997 nekatero obstoječo računalniško opremo nadomestiti z zmogljivejšo, prejšnjo pa smo uporabili za druge namene.

Dan človekovih pravic

Tako kot obe predhodni leti je tudi v tem letu ob dnevu človekovih pravic varuh priredil sprejem za najvišje predstavnike zakonodajne, izvršilne in sodne oblasti, za visoke predstavnike cerkva, univerze v Ljubljani in Mariboru, znanosti ter predstavnike nevladnih organizacij, ki se ukvarjajo s človekovimi pravicami. Vabljeni so bili tudi v Sloveniji akreditirani diplomatski predstavniki tujih držav. Sprejema se je udeležil tudi ombudsman Republike Makedonije, ki je bil v tem času s sodelavci na delovnem obisku pri slovenskem varuhu človekovih pravic.

Ostalo

V tem letu je bil, da bi prikazali delo slovenskega varuha človekovih pravic tudi ombudsmanom v tujini, sorodnim institucijam, organizacijam in drugi strokovni javnosti, ki deluje na področju varovanja človekovih pravic v tujini, izdelan povzetek poročila o delu varuha v angleškem jeziku.

Izdelani in sprejeti so bili nekateri notranji organizacijski in drugi predpisi.
