Act Ratifying the Optional Protocol to the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment

Article 4

In connection with the Act Ratifying the Optional Protocol to the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, the Republic of Slovenia makes the following declaration: "Competences and duties of the national prevention mechanism under the Optional Protocol, in accordance with Article 17, shall be implemented by the Human Rights Ombudsman and, in agreement with him/her, also by the non-governmental organisations, registered in the Republic of Slovenia and organisations that acquired the status of humanitarian organisation in the Republic of Slovenia ."


Article 5

(1)

Ombudsman shall implement the duties and powers of national prevention mechanism under the Optional Protocol. In  Ombudsman's  implementing the supervision at places where persons were deprived of liberty and the supervision of treatment of persons deprived of liberty, may, under this Protocol, participate the non-governmental organizations registered in the Republic of Slovenia, and organizations that acquired the status of humanitarian organization in the Republic of Slovenia engaged in the protection of human rights or fundamental freedoms, particularly in the field of preventing torture and other cruel, inhuman or degrading punishments or treatments.

Organizations who will participate in implementing duties and powers under the preceding paragraph shall be selected on the basis of an open call for tenders carried out by the Ombudsman, who shall also decide on the selection of the organization. Contents of the open call for tenders shall be in accordance with Article 4 of this Act and implementing acts, issued on the basis of the fourth paragraph.

(3)

The persons from the selected organizations participating in implementation of duties and powers of the national prevention mechanism under this Protocol, shall make a preliminary written declaration that they will participate in the performance of duties and powers in compliance in with the instructions of the Human Rights Ombudsman and act according to the regulations on the protection of personal and classified information in the same manner as this applies to the Ombudsman, his/her deputies and employees.

(4)

Pursuant to the first paragraph, the Ombudsman shall pay from the budgetary headings the necessary costs and rewards to the persons from organisations who perform duties and/or exercise the powers, in accordance with the Rules issued by the Ombudsman after the preliminary approval by the minister, responsible for finance. The Rules shall be published in the Official Gazette of the Republic of Slovenia.
